Got a question concerning Chris and whether he even needs to file a return for this year. He has no income other then Soc Sec disability, but received a 1098-T form for tuition payment received. Under normal circumstances, he would not be required to file, but with this form, does he need to file?

I know, call the IRS. I figure I'll ask here first.
 
The 1098-T is just to determine if someone qualifies for the learning tax credit. To qualify, one has to actually have an income tax liability which does not apply to Chris. Therefore he should not have to file (at least based on receiving the 1098-T).

even if only socsec, he should get $250, unless he's a dependent on your return.

Actually nothing needs to be done to receive the $250 payment for those on Social Security. The payment will be automatically by the end of May the same way you are paid your SS (check or direct deposit). The only thing that would need to be done is notifying your SSA office if you do not receive the payment.
 
Thanks, that's what I read into it. He has 0 income, so no credits to get, so no return to file.
 
for confirmation, call the IRS. I did hear one report that stimulus recipients do have to file, whether they have anything to report or not. worth a call.

However, since Chris gets SS disability, he is already in the rolls.
 
This year you do not have to file to receive the stimulus payment. I do taxes for AARP and we do have a lot of people who do not have to file and have no tax liability that want to file so the IRS continues to see a tax form from them for continuity sake I suppose. I choose to do the same thing for my kids even in years in which they do not owe money. The simple awnser is no tax liability no requirement to file. The only other reason would be if he did not file last year and did not receive last years stimulus payment he can receive it this year. Also, whoever is claiming the baby can get the baby's share of the stimulus this year(the one from last years taxes) If you would get more this year you can still get it this year but if your share decreased you don't loose what you already got. Sorry I think I just got confusing but I hope I made sense.

The only persons that must file (If they want it) for the stimulus is if they did not get one last year, they are eligible to get it this year.

this year, like last, you must have earned income to qualify (excepting those
on socsec or disability). if you've saved your money, and are living off your
savings, you get no stimulation.
 
Ross, I told you before If you go ahead & claim him on your &/or Linda's taxes you get more of a break than he would. You would get the dependant tax refund for him. You could than givr him hir refund afterwards. You can claim him for the simple fact that he is living with you & was dependant on you Last yaer for his injuries.

I cannot do that. He has his own disability payments and we did not provide more then half of his support for the tax year. If I did do it, I'd be lying and certainly between all the agencies that he's applied for help from, we would get nailed with fraud when they look into the paper trails. I have plenty of troubles now. I don't need the IRS's attention too.
