Driver pleads guilty in fatal Sandy Twp. crash
Friday, December 22, 2006

CANTON A driver involved in a fatal crash in Sandy Township pleaded guilty Thursday to aggravated vehicular homicide and three counts of vehicular assault.

Stark County Common Pleas Judge Sara Lioi sentenced Jeremy S. Riley, 31, to eight years in prison and suspended his driver?s license for life.

Riley of 1333 Huron Rd. SE in Massillon was involved in a fatal traffic crash on Sept. 16 at Route 43 and Willowdale Avenue SE in Sandy Township.

Riley tried to pass a large truck and other vehicles in a no-passing zone on Route 43 when his car struck another car head-on, according to an Ohio Highway Patrol report.

A passenger in the second car, Glenda S. McKelley, 49, of 38th Street NW died in the crash. Riley and three others, including his passenger, were injured.

According to the indictment, the crash resulted from Riley?s recklessness.

It occurred a few months after his release from prison for a 2001 felonious assault conviction, prison records show.

It's not enough time, Ross, but I'm glad Chris and his friend won't have to go through the agony of testifying.

Now presumably the civil action needs to be addressed since he has held his hands up.

With his record, will banning him from driving actually achieve anything? In my experience some career criminals will just drive with no licence.

I am glad that he is 'banged up' for Christmas, a minor satisfaction.

8 years, minus how many for "good" behavior. Out to drive again, because I'm sure he couldn't care less about that pesky driver's license thing. Is Chris relieved to not have to testify, or was he hoping to be able to do so?

As soon as I read this, my first thought was relief that at least the famlies won't have to go thru court especially how sore Chris must be and how you don't need one more sec of stress or worrying about getting there ect can just concentrate on things that get you all better in 07
sadly my second thoughts were about like everyine here, 8 years and no dl for life, so what in 5 years he will be in his next accident if not sooner?
You have been in my prayers for a much better 07, maybe this is just the little start of less stress and healing for your family, Lyn

Not Enough Time.....

Not Enough Time.....

Ross,

While I am glad that Chris won't have to testify, I don't think that they gave this guy anywhere near the amount of time that he needs to serve for this horrific tragedy....He only has to serve 8 years...Everyone else's pain and suffering goes on for a much longer time than that, besides like Karlynn said, this dude is NOT going to let a little thing like a permanent license suspension to keep him from driving...This Dude took a life, and really screwed up the others lives...He needs a lot more than 8 years of jail time......I hope you all are doing ok with this and that Chris and Savannah are recovering quickly and healing from this. Thoughts and Prayers going out for all of you. Harrybaby:eek:

Ross:

I'm sorry he got only 8 years.
Does an 8-year sentence in Ohio really translate to 8 years served? It doesn't in Texas, because you get credit for time served before entering prison & "good" behavior.

This is a travesty. This slug obviously knows how to play the system and will be out way too early. In addition, he will drive with or without a license and go on to kill someone (or more) else.

When will this country learn that you cannot give people like this a break? We "normal" people do not get breaks, why should someone who has caused so much pain?

Ross, I feel for you and your family. I wish you could force a jury trial because a jury would lock this guy up for good. Just what was this judge thinking?

Sorry to rant. I hope your family can find some peace in knowing he is off the streets for now. Maybe God will provide His own justice and somehow keep this guy from ever getting out.

No, it doesn't seem right. I'm sorry that a family will be without their mother and loved one at this time of year (and forever) and a weasel of a man merely misses 8 Christmases...if that.

I'm sorry. I'm sure you are fuming.

Marguerite

Ross,
So sorry to hear of the short sentence but So very glad that Chris and Savannah (and her family)do not have to deal with the torture of a trial.

I missed replying to your post about your recent check-up - I'm sorry for the setback and send prayers your way that all will work out with your doc's plan.

You and yours have my very Best wishes for a Healthy and Happy New Year!
Peace
Susie

Eight years is WAY too little. However, at least you're not going to have to deal with having to go to trial.

DON"T even bother with a civil action.....you can't get blood from a stone. He has nothing, especially after just getting out of prison, and won't ever have anything.....it's not worth the expense.

JMHO

Ev

ps. at least you can all have a good holiday....you have your son.

Well the guy had a habit of driving with no license or insurance, so taking his priviledge away for life is just a joke.

We wanted it to go to trial and take the chances with the judge, because the additional charges could have tacked on another 1 1/2 years. Unfortunately, under Ohio law, if this is the first aggravated vehicle homocide, then the max sentence is 5 years. Had he killed another, he would have gotten much more time. He took the 8 year plea deal and I'm sure that it will not equate to 8. I bet the guy is out in as little as 4 for good behavior. He'll get out, find a car, go drinking and kill someone else, mother, father, daughter, son etc.

We stand no chance of getting any money out of this guy and we have applied for every possible avenue of relief for Chris to get these bills paid. Were up to nearly $150,000 and the next surgery is at the end of next month. To date, no one has received a penny and they are all getting restless. Bottom line is, we still don't have an answer as to what he is eligible for and won't know for at least 6 months.

Gotta love the system!

Give the guy a job in prison and make him start paying all the medical bills for the people he hurt. Oh, right, that would probably violate his rights.

Does Ohio have a Violent Crimes Compensation Bureau? If so, I would apply there. Also, find out if this jackanapes has any material possessions at all. Grinch him: take his shoelaces and his last can of Who-Hash.

See if you can put a lein on any future earnings he may have - including in prison. No reason he should be able earn money for cigarettes by making license plates while in custody.

In NJ I believe there's an insurance fund that covers uninsured motorists. Does Ohio have that?

Bad breaks, Ross. Keep pluggin' at it.

Best wishes,

I hope there is someway..that Chris and Savannah's family can keep up with this jerk while he is in prison..Like, when his parole appeal comes up..Hopefully by then, Chris will be fully recovered..:) and anyone involved in this wreck..can go and talk to parole people and try to keep him behind bars.....I wonder if there is a law on the books..that they must be notified?.Chris and Savannah's family?..Bonnie

Most states have a website where you can track a defendant through the court system. This case will still have an open docket until the time that he fulfills the sentence. Any parole hearings will be part of the information on the site, so if you keep track of him Ross, the victims in this case will be able to ask to submit letters to the parole board.
Missouri has this system; probably Ohio does too.

I'm to get the depostion in the mail and forms from the state parole board to fill out so that we are notified when he is released. We are not done with him. He still has our civil suit to face, but as the attorney said, getting a judgement against him and getting the money is complelely different.

Yes our state has the victims compensation fund, but it, like everything else is waiting for a determination of eligiblility. I'm so angry that this guy gets little time, can't pay anything cause he has nothing, can wreck peoples lives like this and walk off into the sunset taken care of.

Eight years is certainly way too lenient. While the justice system may work in some cases, this is a classic example of how it is broken and must be fixed. It is too bad the damage to the victims and their families cannot also be taken into account. It that were the case, he would never see the light of day.
