thanks for responding to this, nicole. i was curious about the outcome too, and i'm glad it worked out.

as for the dr not losing her license, i know you want to protect others, but only the board can cause a dr to lose her license, not a civil lawsuit. it seems to take a lot to take a LOT to make a board revoke a dr''s lawsuit because they seem to take into account a lot of room for human error/bodies being not all alike -- which is a good thing in some respects, and other times, maybe not so much. but the public can always check a doctors' malpractice/disciplinary cases at your state's medical board site. though i guess that not many patients do this. when's the last time you checked your doctor's history? it's my opinion that not many people are aware of how to go about doing this, or even if they do, certainly don't tend to look into malpractice claims of doctors when they first start seeing one. anyway, here's an example of where you'd go to look:
